Newton’s Tree Ordinance

The City Council is close to voting on significant changes to Newton’s Tree Ordinance.  While there are some very positive changes that will strengthen the ordinance, there also are important weaknesses that will diminish our ability to protect and expand our tree canopy for the health and welfare of all residents.  As the climate crisis grows at a much more alarming rate than predicted even months ago, is imperative that our Tree Ordinance address these concerns immediately.  There are two significant issues that should be changed.

The proposal exempts all 1-2 family residential lots where no exterior construction is planned for 24 months and the Newton Cemetery and Arboretum from proposed tree protections and replacement requirements.  

  • There should be no exemptions for healthy, non-dangereous trees over 6” DBH (Diameter at Breast Height).  ALL trees, regardless of where they stand, bring environmental and health benefits to ALL of us. I believe that this is an issue of the government's responsibility to protect all citizens from acts by any citizen that will harm the general good of the entire populace.  The only waiver of payment or replacement should be only if the application process provides acceptable certification that the protected tree is dead, diseased, dangerous or that the removal of the tree will improve the overall health of the tree canopy.  Appeal for special consideration is always available.

The proposal protects only trees greater than 40” in diameter at breast height (DBH) on all properties.  There are no protections for trees 6” – 39” DBA anywhere.

  • All healthy and non-dangerous trees greater than 6” DBH should be protected.

Fossil Fuels

The City should continue efforts to expand its Newton Power Choice program and make it easier for homeowners and renters to heat and power their homes with clean energy.  It also should move to formalize efforts to require that all new construction must have fossil fuel free energy sources  for commercial and residential development.
